1. SUBJECT - THE SKIBRID
The SKIBRID ® is an article / range of sports and leisure articles for family, individual or team use, and is not designed for competition. Its use in the mountain environment presents the same risks as for items such as skis, touring skis, sledges, snowboards, snowshoes, and all snow gliding equipment.
2. SCOPE OF APPLICATION
The present general conditions of sale apply for private individuals and for all products, accessories and spare parts of the SKIBRID® range, sold online on the site https://skibrid.com/ or directly from our sales department.
3. ORDERS ON SITE
The fact of buying on the site implies acceptance of these general conditions of sale. At the time of your first purchase, you will be offered, optionally, to become a member of our community of SKIBRID® users, and to create a customer account to ensure a quality follow-up of your products. In accordance with the provisions of the law 2014-344 of 17/3/2014, a complete summary of your order will be presented to you before payment, and recalling the characteristics of the products ordered, their price and quantity, total amount of the order excluding VAT and including VAT, including delivery time, taking into account product availability. charges and delivery method, billing and delivery address, payment method applied.
A confirmation e-mail will be sent to you, including all these elements of your order. We reserve the right to modify the prices at any time, but the products will in any case be invoiced on the basis of the rates in force at the time the order is placed.
Secure payment by our partners Caisse d'Epargne and Stripe: by credit card or via PayPal. The amount of the order is debited at the time of shipment of the order.
The order will only be considered firm and definitive at the end of the online payment procedure. Thus, we reserve the right to refuse any order or to honour a delivery in the event of a payment dispute. The products remain our property until complete collection of the sums due.
Withdrawal period: pursuant to the law of 17/3/2014, you have a right of withdrawal of 14 days after receipt of your products, by filling out the following online form: email@example.com. This form recalls the conditions defined by law, it states in particular that you have a maximum of 14 days to return the products at your expense, in the original packaging. The reimbursement of the order will take place after receipt of the products; the amount will be variable and adjusted on a pro rata basis in case of retraction and/or partial return. Shipping costs will be refunded at the standard rate.
SKIBRID® has been designed and tested to withstand family and recreational use. It is guaranteed for 24 months as long as it conforms to the goods ordered, against any manufacturing defect or damage not resulting from abnormal use, normal wear and tear being excluded from the guarantee. The same applies to damage occurring during transport or storage of the product, failure to comply with the instructions for assembly and use described in the instructions enclosed in the packaging, nor in the event of modification, shocks produced by sharp objects, torsion, compression not resulting from normal use.
The guarantee can only apply to a product returned in its original packaging, and in the absence of any modification or repair not carried out by us.
The warranty shall consist of the choice offered by the manufacturer between repair or replacement of the defective parts, at the choice of the consumer, without this choice entailing disproportionate costs compared to the other choice.
The warranty period of 24 months runs from the date of delivery, or, in the absence of a delivery note signed by the customer, from the invoice + 8 days, and can only benefit the holder of the original invoice issued by us.
This warranty applies in any country of destination of the initial sale, unless special conditions in connection with the legislation of the country of destination.
Limitation of liability :
The warranty is exclusive of any other liability of the manufacturer for any indirect damage resulting from the defect found, including loss of use. Abnormal use, outside the purpose described in Article 1, and especially for competition is not covered by the warranty.
Only the delays mentioned online are valid because they take into account our availabilities.

Article 1 - Preamble and Purpose

Article 2 - Responsibilities
Responsibility for the contents posted by the USERS.
SKIBRID is not responsible for the content posted on the site (images, photographs, comments, etc.) by USERS, but reserves the right to moderate or delete said comments if they infringe the rights of a third party or contravene, in any way whatsoever, the laws and regulations in force.
Site accessibility and malfunctions
SKIBRID undertakes to make its best efforts to ensure that the site is accessible and operational at all times. In this respect, SKIBRID and with regard to an obligation of means and not of result, SKIBRID does not offer any guarantee of continuity of its services.

Consequently, SKIBRID may not be held liable by the USER for any damage, in particular in the event of loss of data or damage to the USER's equipment, which may occur as a result of the use of the Application.
In any event, SKIBRID's liability, if proven, shall be limited to providing access to the Application in accordance with the provisions of these general terms of service.
Compensation for any other damage and in particular any indirect, material or immaterial damage, such as moral, financial, loss of chance, loss of profit, damage to image, etc., is excluded.
SKIBRID has an insurance policy covering the pecuniary consequences of its civil liability in the event that it is involved.
Article 3 - Account creation
As part of the registration process in the "login" section, the User creates an account, and adds information related to his account: name and email first, then additional information as part of an order (see Terms and Conditions of Sale). In this context, the User agrees to : (a) provide true, accurate, current and complete information or use the Services on behalf of an entity, about the entity, and (b) maintain and promptly update the Registration Information to keep it true, accurate, current and complete. In the event of a dispute between two or more parties regarding the ownership of an account, User agrees that SKIBRID shall be the sole arbitrator assigned to such dispute in its sole discretion and that SKIBRID's decision, which may result in the termination or suspension of the disputed accounts, shall be final and binding on all parties involved.
The User is responsible for maintaining the confidentiality of his or her account details, and is fully responsible for all activities that occur under his or her account, including, without limitation, all actions of sub-users registered under his or her account. User agrees to immediately notify SKIBRID of any unauthorized use of his account and any other security breaches.
3. Age restrictions
The User must be at least eighteen (18) years of age, or have reached the legal age of majority in the jurisdiction in which he or she resides, whichever is greater, to use the Services. Otherwise, a minor User may use the Services only in the presence of a parent or legal guardian. Under no circumstances will the User use the Services if he is under thirteen (13) years of age.
Article 4 - Confidentiality & personal data
1. Purpose of this charter
The purpose of this charter is to inform the User about the means implemented to collect personal data, in the strictest respect of his rights. SKIBRID indicates on this subject that it complies, in the collection and management of personal data, with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, in its current version and with the GRDP (General Regulations on Data Protection).

3. Collection of personal data
Personal data is collected for one or more of the following purposes :

- Carry out operations related to the management of Clients/Organizers concerning contracts, orders, deliveries, invoices, loyalty programs, follow-up of the relationship with the Clients,

Article 9 - Non-waiver
SKIBRID's failure to enforce, require enforcement, or exercise any of the provisions of these terms and conditions shall not be construed as a waiver of any subsequent reliance on such provision or any other provision.
Article 10 - Modifications of the present general conditions of service
. SKIBRID reserves the right to modify the provisions of these general conditions of service at any time and without notice.
Users will be bound by these modifications and should therefore periodically check whether their use complies with the provisions of the General Terms of Service in the version in force.
Article 11 - Applicable law, jurisdictional competence and independence of clauses
. The present general conditions of service are subject to French law.
In the event of a dispute concerning, in particular, these general terms of service or the use of the website, the jurisdiction is that of the French courts. The competent court will be designated according to the rules of procedure in force in France.
In the event that one or more stipulations of these conditions should be considered invalid, the validity of the other stipulations shall not be called into question unless they are inseparable from the stipulation.

In application of the law of 17/3/2014, you benefit from a right of retraction of 14 days after the reception of your products at your home.
Before making any return, we ask you to send us an email to email@example.com with your Name / First name and your number and indicating in the subject "Return order number xxxx"
. You have a maximum of 14 days after receiving the product at your home to return the products at your expense, in the original packaging.
Upon receipt of your return package, we check the conformity of your return. No return will be accepted if the returned products have been visibly used or damaged by the Buyer and that this use or damage makes the products unfit for sale. If your return cannot be accepted, we will contact you for the return of the products at your expense.
The refund of the order will take place after receipt of the products; the amount will be variable and adjusted on a pro rata basis in case of withdrawal and / or partial return. Shipping costs will be refunded at the standard rate.
